Two-Way Notification SMS Terms of Service

The Dataminr Two-Way Notification SMS mobile message service (the “Service”) is provided by Dataminr, Inc. (“Dataminr”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“SMS Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these SMS Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes. 

You are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply. 

If you have opted in, the Service will notify you during critical events via text messages through your wireless provider to the mobile number provided. You will receive a variable number of messages at unpredictable intervals. In addition to text messages, you will also receive alerts via other means, including phone calls and email. Text the single keyword command STOP to 36467 or the number you are receiving messages from to cancel at any time. You’ll receive a one-time opt out confirmation text message. If you have subscribed to other Dataminr mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective SMS terms. We may change any short code or telephone number we use to operate the Service at any time. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages. 

Compatible wireless carriers include: Metro PCS, AT&T, T-Mobile®, C Spire Wireless, ClearSky, US Cellular, Verizon Wireless, Google Voice, Interop, BCE Inc., Bell Mobility, Lucky Mobile, PC Mobile, Virgin Mobile, Rogers, Chatr, Fido, TELUS, Koodo, Public Mobile, Bell MTS, Eastlink, Freedom Mobile, Iristel, Ice Wireless, SaskTel, SSi Canada, Vidéotron, Fizz, and Xplore Mobile. The wireless carriers supported by the Service are not liable for delayed or undelivered messages. Notifications sent via SMS may not be delivered to you if your phone is not in range of a transmission site, or if sufficient network capacity is not available at a particular time. Even within a coverage area, factors beyond the control of your wireless carrier may interfere with message delivery, including the customer’s equipment, terrain, proximity to buildings, foliage, and weather. You acknowledge that urgent notifications may not be timely received. Message delivery is not guaranteed by the wireless carriers. Any notifications sent over the Wireless Public Alerting System shall take precedence over any notifications sent via the Common Short Code.

You agree to provide us with a valid mobile number capable of receiving text messages from us. You agree to maintain accurate, complete, and up-to-date information with us related to your receipt of messages. You agree to not use the Services or permit the Services to be used (i) for any improper, fraudulent, immoral or unlawful purpose, (ii) for the transmission of any material which is of a defamatory, offensive, illegal, abusive, obscene or menacing character or nature, (iii) in a manner that infringes the intellectual property rights or any other proprietary rights of any third party, or (iv) for marketing or commercial purposes.

To the extent permitted by applicable law, you agree that Dataminr will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service. Dataminr is not responsible for technical, hardware, software, electronic, network, telephone or other communications malfunctions, errors or failures of any kind, errors in transmission, traffic congestion, lost or unavailable network connections, telephone connections, wireless phone connections, website, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed transmissions which may limit or restrict your ability to receive or send a message, including any injury or damage to your or any other person’s wireless device relating to or resulting from participating in or using the Service. Dataminr makes no warranties, and hereby disclaims any and all warranties in connection with the Service. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND DATAMINR HEREBY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSES AND/OR NON-INFRINGEMENT.

By participating, you agree to release and hold harmless Dataminr and its respective representatives, agents, successors, assigns, employees, officers and directors, from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with the Service, and for any claims based on violation of law or infringement or violation of any rights of any person or entity, including, without limitation, violation of publicity rights, defamation, invasion of privacy.
